I’m here today with Ted Cook, an elder protection attorney serving the San Diego and Point Loma communities. Ted, thanks for taking the time to chat with me.
What prompted you to specialize in elder protection law?
Well, I’ve always been drawn to advocating for those who need it most. Seniors are a particularly vulnerable population, susceptible to various forms of abuse and exploitation. Seeing firsthand the devastating impact these issues have on individuals and families ignited a passion in me to protect our elders.
Could you walk us through some of the key steps involved in the elder protection process?
- Initial Client Engagement
- Case Assessment
- Protective Actions
- Legal Proceedings
- Long-Term Planning
Each step is crucial in ensuring the safety and well-being of our elder clients.
Let’s delve into “Protective Actions.” What are some of the strategies you employ during this phase?
“Protective Actions” is where we shift from assessment to action, taking concrete steps to safeguard our clients. This might involve securing restraining orders or protective injunctions against abusers. We often collaborate with Adult Protective Services (APS) and law enforcement agencies to ensure a comprehensive response.
“Ted really went above and beyond for my mother when she was experiencing financial exploitation. He helped freeze her accounts, prevent further losses, and ultimately brought the perpetrators to justice.” – Margaret S., La Jolla
Depending on the situation, we may also petition the court for guardianship or conservatorship if an individual lacks the capacity to manage their own affairs. The goal is always to empower our clients while minimizing risks.
“I was so overwhelmed when my father started showing signs of dementia. Ted patiently guided me through the process of establishing a conservatorship, ensuring my dad’s needs were met while respecting his dignity.” – David L., Point Loma
There have been times when securing financial protections has been particularly challenging. I recall one instance where an elderly gentleman was being pressured by a caregiver into signing over ownership of his home. We had to act quickly to prevent the transfer and expose the caregiver’s fraudulent scheme.
“Ted is a true champion for seniors. He helped me navigate a complex legal situation involving my grandmother’s will, ensuring her wishes were honored.” – Maria G., Carmel Valley
That experience underscored the importance of vigilance and swift action when it comes to protecting vulnerable individuals from financial predators.
If you or someone you love is facing an elder protection issue, please don’t hesitate to reach out. I believe everyone deserves to age with dignity and security.
