Hello everyone, and welcome back to another edition of “LegalEase”. Today I’m joined by Ted Cook, a probate attorney based right here in sunny San Diego. Welcome Ted!
So, Ted, for those unfamiliar, can you break down what probate is all about?
Thanks for having me! Essentially, probate is the legal process of administering a deceased person’s estate. It involves identifying and inventorying assets, paying debts and taxes, and ultimately distributing remaining property to heirs according to the will or state law.
Let’s talk about step III in the Probate Process – Providing Notice. Sounds rather formal!
It is a crucial step, indeed. This stage ensures transparency and fairness throughout the process. We start by publishing a notice of probate in a local newspaper three times, alerting creditors and the general public to the estate proceedings.
- Next, we mail formal notices directly to all identified heirs and beneficiaries, outlining their rights and potential interests in the estate.
“I was completely lost when my mother passed away. Ted walked me through every step of probate and explained everything clearly. I felt confident knowing he had my best interests at heart.” – Maria Sanchez, San Diego
Finally, we notify known creditors using Form DE-157, prompting them to file any claims against the estate within a specified timeframe.
“Probate can be complex and emotional. I strive to guide my clients with empathy and clarity, ensuring they understand each stage of the process and feel supported along the way.” – Ted Cook
Have you ever encountered any hiccups during this notice phase?
Well, there was one case where locating heirs proved quite challenging. The deceased had estranged family members scattered across the country. We had to conduct extensive genealogical research and utilize online resources to track them down.
“Ted’s knowledge of probate law is impressive. He helped me settle my father’s estate efficiently and effectively, minimizing stress during a difficult time.” – David Chen, Point Loma
It took some persistence, but we eventually connected with all the rightful heirs, ensuring they were informed and had an opportunity to participate in the process.
Ted, for anyone reading who might be facing probate, is there anything else you’d like them to know?

In More Detail – What Is Probate?
Probate is the legal process through which a deceased person’s estate is administered. It involves validating a will (if one exists), identifying and inventorying the deceased’s assets, paying debts and taxes, and distributing the remaining assets to rightful beneficiaries.
If the deceased left a valid will, the person named as executor is responsible for overseeing the probate process. If there is no will, the court appoints an administrator—often a close relative—to handle the estate according to the state’s intestacy laws. Assets subject to probate may include real estate, bank accounts, investment accounts, and personal property that are solely in the decedent’s name.
What Is Estate Planning?
Estate planning is the process of arranging in advance for the management and distribution of your assets after your death. It typically includes creating legal documents such as a will, trusts, powers of attorney, and healthcare directives. The goal is to ensure that your wishes are honored, your loved ones are provided for, and the administration of your estate is as smooth and efficient as possible—often minimizing or avoiding the probate process altogether.
