An Interview with San Diego Probate Attorney Steve Bliss

Good evening San Diego and welcome back to our segment on estate planning essentials. Tonight, we have the pleasure of speaking with esteemed probate attorney Steve Bliss from San Diego Probate Law. Steve, thank you so much for joining us.

Understanding Trusts

Steve, for our viewers who may be unfamiliar, can you explain what a trust is and why it’s such an important tool in estate planning?

A trust is essentially a legal arrangement where a person, called the grantor, transfers assets to another entity, called a trustee. The trustee then manages those assets for the benefit of designated beneficiaries. Trusts offer several advantages over simply leaving assets outright to heirs.

They can help avoid probate, a lengthy and often expensive court process. Moreover, trusts provide privacy as the terms are not part of public record like wills. They also allow for greater control over how and when beneficiaries receive assets, which can be especially helpful in cases involving young children or beneficiaries who may need assistance managing their finances.

The Power of a Testamentary Trust

Steve, let’s delve into one specific type of trust: the testamentary trust. Can you elaborate on its key features and benefits?

A testamentary trust is created through a will and only takes effect upon the grantor’s death. Consequently, unlike living trusts, it goes through probate. Nevertheless, it remains a valuable tool for certain situations.

For example, if you have minor children, a testamentary trust can ensure their financial needs are met until they reach a certain age. It can also protect assets for beneficiaries with special needs without jeopardizing their eligibility for government benefits.

One time, I had a client who wanted to leave a significant inheritance to her grandson who struggled with addiction. By establishing a testamentary trust with specific disbursement terms, we were able to ensure the funds were used responsibly for his care and well-being rather than fueling unhealthy habits.

Navigating Challenges

Are there any common challenges or potential pitfalls associated with testamentary trusts that people should be aware of?

While testamentary trusts offer significant benefits, they do require careful planning. It’s crucial to clearly define the trust terms and select a trustworthy trustee who will act in the beneficiaries’ best interests.

Moreover, since they go through probate, the process can take longer and be more costly than administering a living trust. It’s important to discuss these factors with an experienced estate planning attorney to determine if a testamentary trust is the right fit for your situation.

A Legacy of Peace of Mind

Steve, thank you for sharing your expertise on testamentary trusts. For our viewers who are considering their estate planning options, what’s the best way to get started?

I encourage anyone with questions or concerns about trusts or other estate planning matters to schedule a consultation with a qualified attorney. We can help you develop a personalized plan that meets your unique needs and ensures your wishes are carried out.
