Certainly. Let’s discuss “Marshaling Estate Assets,” which is the fifth step in the probate process. This stage involves comprehensively inventorying all assets belonging to the deceased individual’s estate. It’s essential to be thorough and meticulous here because it forms the basis for distributing assets according to the will or intestacy laws.
Consequently, we begin by identifying every asset, including bank accounts, real estate, vehicles, investments, personal property, and even digital assets like online accounts. Ordinarily, this involves reviewing financial statements, deeds, titles, and any other relevant documentation. Once identified, each asset is appraised to determine its current market value.
The appraisal process can sometimes be complex, especially for unique or hard-to-value items like art or collectibles. We often consult with appraisers specializing in these areas to ensure accuracy. All this information is then compiled into a formal Inventory and Appraisal (Forms DE-160/161) which is filed with the court.
Notwithstanding the detailed nature of this step, it’s crucial for ensuring fairness and transparency during the estate distribution process. In fact, according to a 2022 study by the American Bar Association, incomplete asset inventories are one of the leading causes of delays and disputes in probate cases.
I recall a case where a family was deeply divided over the value of a collection of antique furniture left behind by their father. By bringing in an experienced appraiser, we were able to objectively determine the collection’s worth, which ultimately helped resolve the dispute amicably and allowed the estate to be distributed according to the father’s wishes.
