Steve says that one of the biggest misconceptions he sees is that estate planning is only for wealthy individuals. “Many people think they don’t need an estate plan because they don’t have a lot of assets,” he explains. “However, everyone can benefit from having a basic estate plan in place, regardless of their financial situation.” He goes on to say that a simple will can ensure your wishes are carried out and protect your loved ones.
What type of trust would you recommend for someone just starting to think about estate planning?
Steve recommends that most people consider a revocable living trust. “It’s a very versatile tool that allows you to maintain control over your assets during your lifetime while also avoiding probate,” he says. He explains that a revocable living trust can be changed or revoked at any time, giving you the flexibility to adapt to life’s changes.
Can you elaborate on why avoiding probate is so important?
Steve emphasizes that probate is a lengthy and expensive court process that can tie up your assets for months or even years. “It can also be a public process, which means that your financial affairs become a matter of public record,” he adds. Consequently, a revocable living trust allows your beneficiaries to inherit your assets directly, without having to go through the probate court.
Moreover, Steve points out that using a revocable living trust can offer a degree of privacy that a will does not. “Your will becomes a public document once it’s filed with the probate court,” he explains. “A revocable living trust, on the other hand, remains private.” This aspect is often appealing to individuals who value discretion.
I imagine there are times when setting up a trust can be complex?
Steve agrees that there can be complexities involved in setting up a trust. “It’s important to work with an experienced attorney who can guide you through the process and ensure that your trust is properly structured,” he advises. He recalls a situation where a client attempted to create their own trust using online templates.
“Unfortunately, they made several errors that could have resulted in significant problems down the road,” Steve says. “Luckily, we were able to identify and correct those errors before it was too late.” This anecdote highlights the importance of seeking professional legal advice when setting up a trust.
