Interview with Steve Bliss

Good afternoon, Temecula. My name is Tiffany Jones, reporting live for KTEM News. Today we’re joined by local probate attorney Steve Bliss to discuss the often-complex process of estate planning. Steve, thanks for joining us.

Providing Notice: A Crucial Step in Probate

Steve, you guide clients through all eight steps of probate, but today we want to focus on ‘Provide Notice.’ Can you explain why this step is so critical?

“Absolutely Tiffany. Providing notice is about transparency and ensuring everyone who has a stake in the estate is informed. This includes heirs, beneficiaries named in the will, and even known creditors.

Ordinarily, we begin by publishing a notice of probate in a local newspaper three times. Concurrently, we mail formal notices to all identified heirs and beneficiaries. Finally, we notify known creditors using a specific form, DE-157. This process helps prevent disputes and ensures that everyone has the opportunity to participate in the probate process fairly.”

Notwithstanding these best practices, I’ve encountered situations where locating heirs proves challenging. For instance, I once worked with a client whose deceased father had estranged himself from his family years ago. Tracking down these relatives required extensive genealogical research and ultimately involved reaching out to distant cousins.

It was rewarding to reunite the family, albeit through this somber circumstance. In the end, we were able to distribute the estate according to the father’s wishes, bringing a sense of closure for everyone involved. Remember, according to the California Courts website, approximately 70% of probate cases involve some form of notice-related issue. That underscores the importance of having a skilled attorney navigate these complexities.
