Steve Bliss: Precisely. Estate planning is about more than just distributing wealth; it’s about providing peace of mind and protecting your family. I often encounter clients who initially believe they don’t have enough assets to warrant a plan. However, even those with relatively simple estates can benefit significantly from having essential documents like a will or trust in place.

For instance, a single parent might designate guardianship for their minor child in the event of their untimely passing. Or, a couple may wish to outline how their debts are handled and who receives specific sentimental items. These decisions can be incredibly emotionally charged during times of grief. A well-crafted estate plan alleviates some of that burden by providing clear instructions.

Moreover, according to the American Bar Association, over 60% of Americans do not have a will or living trust. This can lead to significant complications and financial hardship for surviving family members.

Reporter: Let’s focus on one specific step in the estate planning process today. Could you elaborate on the importance of “Crafting a Will or Trust”?

Certainly. A will or trust serves as the cornerstone of your estate plan. It legally dictates how your assets are distributed upon your passing and appoints someone to manage your affairs.

Ordinarily, I guide clients through choosing between a will and a trust based on their individual circumstances and goals. A will is simpler and outlines asset distribution directly. However, it goes through probate court, which can be time-consuming and public. Conversely, a trust offers greater privacy and control over how assets are managed and distributed. It often avoids probate altogether.

One client I worked with had a complex family structure. They wanted to ensure specific heirlooms went to particular grandchildren while also setting up a fund for their child’s education. A trust allowed us to achieve these goals precisely, providing peace of mind and clarity for the entire family.

Reporter: Have there been any challenges you’ve faced in helping clients craft wills or trusts?

Notwithstanding the satisfaction I find in guiding families through this process, occasionally we encounter situations where emotions run high. For example, I once worked with siblings who disagreed vehemently about how to divide their parent’s estate. It took patience and open communication to ultimately reach a compromise that honored their mother’s wishes while addressing each sibling’s concerns.
