Consequently, it’s vital to choose someone trustworthy, capable, and willing to take on this significant responsibility.
Think about it like choosing a captain for your ship. You want someone who is level-headed, organized, and able to navigate through any storms that may arise. Moreover, they need to be someone you trust implicitly with your financial affairs and personal wishes.
Ordinarily, people choose a family member or close friend, but it’s not uncommon for individuals to select a professional trustee like a bank or trust company, especially if their estate is complex.
Notwithstanding the choice, clear communication with your chosen executor or trustee is paramount. Discuss your expectations, provide them with all necessary documentation, and ensure they understand your goals for asset distribution.
I’ve seen firsthand how a lack of communication can lead to confusion and disputes amongst family members during an already difficult time. It’s important to remember that while choosing the right person is crucial, openly discussing your wishes with them beforehand can prevent potential heartache down the road.

Speaking of heartache, I understand there have been instances where executors faced unexpected challenges?
Unfortunately, yes. Once, a client named their adult son as executor, believing he was responsible and capable. However, the son was overwhelmed by the task and ultimately made some poor financial decisions that cost the estate significantly. It was a painful lesson for everyone involved.
Another time, I worked with a family where the chosen executor had passed away before administering the estate. This unexpected turn of events led to delays and legal complications until a new executor could be appointed.
